Rules and Regulations for the Members of Piyush Heights Residents Welfare Association

Introduction

This code of conduct shall be applicable to the current Residents Welfare Association Governing Body and the candidates contesting the elections of the Residents Welfare Association Governing Body for which these elections are being held.
This code of conduct will enforce from immediate effect for conducting free & fair elections for the Governing Body of Piyush Heights Residents Welfare Association, Sector 89, Faridabad and will remain in force till results of the election are declared.

Code of Conduct for the existing Governing Body

The existing Governing Body of the “Piyush Heights Residents Welfare Association, Sector 89, Faridabad” shall

Dos

  • Extend full administrative support to the Returning Officer to conduct the election. Such support will include providing updated list of members to the Returning Officer and making available all required administrative infrastructures of the Residents Welfare Association to the Returning Officer to conduct the election.
  • Continue to conduct such activities which are required for maintaining day to day functions of the Resident Welfare Association.

Don’ts

  • Do Not start any new project on its own or through the maintenance agency other than routine/day to day maintenance of the society. In case such a project is required in case of an emergency, it will first notify the Returning Officer and will act in accordance with the permissions of the Returning Officer.
  • Do Not call any meeting of the residents to discuss or decide upon any issue.
  • Do Not organize any Cultural Function (other than Christmas or New Year Eve Programme, Sarswati Puja etc. which are being celebrated every year) or promotional event that may affect free & fair election process in the premises of Piyush Heights, Sector 89, Faridabad.
  • Status Quo should be maintained and Do Not nominate any new member to the Governing Body or remove/sack any existing member of the Governing Body.
  • Do Not initiate any new/fresh legal case against the maintenance agency, other service providers, employees, members, builder or any third party. The Residents Welfare Association can, however, continue to make representations in existing legal cases/matters on the dates of regular hearings.
  • Do Not recruit or dismiss key members of its staff. In case such recruitment and dismissal is required in an emergency it will first notify the Returning Officer and will act in accordance with the directions of the Returning Officer.
  • Do not change any service provider involved in providing regular maintenance to the society. In case such a change is warranted on account of any emergency, it will notify the Returning Officer and will act in accordance with the direction of the Returning Officer.
  • Do not allow use official vehicles, equipment or premises of the Resident Welfare Association for the benefit of any person contesting elections for the Piyush Heights Residents Welfare Association, Sector 89, Faridabad.

Code of Conduct for the contesting candidates

The candidates contesting for the position of the Governing Body shall

Dos

  • Carry out the election campaign in a peaceful manner.
  • Make public such information about their profession, educational qualification and business interests which are considered relevant by the Returning Officer.
  • Undertake canvassing in a peaceful manner through door to door campaigns, group meetings or use of electronic media network (i.e. Website, Facebook, Emails, WhatsApp etc.).

Don’ts

  • Use loudspeakers for canvassing or organizing group meetings is prohibited.
  • Do not put posters in the premises of the Piyush Heights Sector 89. However, distribution of pamphlets to the voters are permitted.
  • Do Not involve persons not residing in Piyush Heights Sector 89 for campaigning.
  • Do Not cause or threaten to cause physical harm to voters, other candidates, Returning Officer or election team or other volunteers involved in the election process.
  • Do not solicit votes in the names of the caste, religion or race.
  • Do not make derogatory statements against people belonging to any caste, religion, state/country, race, sex or profession.
  • Do offer or promise to offer money, gift or any other inducement to the voters.
  • Do not prohibit Returning Officer or other officials and volunteers involved in election duty from performing his/her/their duties.
  • Do not conduct campaign or interact with the Returning Officer or other officials or enter the premises where voting or counting is undergoing under the influence of alcohol or other intoxicants.
  • Do not use Piyush Heights Residents Welfare Association’s official communication medium (i.e. WhatsApp group “Piyush Heights RWA”, Google Group “piyushheightsresidents”) for campaigning or canvasing for election.

Enforcement of Code of Conduct


The Returning Officer, after receiving a written complaint from any contesting candidate or member of the Residents Welfare Association or any governing body member will initiate an enquiry and will provide an opportunity to the concerned party/parties to make an oral/written representation. After considering all the representations the Returning Officer in consultation with his election team will pass appropriate orders. Such order may include warning or disqualification of candidature of one or more candidates. Order of the Returning Officer will be final and binding to all.
